LOS VIENTRES DE ALQUILER

A veces creo que mi país se quedó en la línea de salida en el inicio de la modernidad relacionada con la concepción . Estamos llenos de feministas, de izquierdistas, de personas que están a favor de los derechos humanos… pero en España todavía no se puede abortar libremente y tampoco alquilar un vientre cuando 1000 españoles recurren cada año a este tipo de gestación.

Todo avanza menos lo relacionado con la familia y la mujer aunque si oímos los comentarios políticos, sean del color que sean todos luchan por igualdades… está claro que este aspecto no entra.
Bien, hablemos de este tema tan interesante y tan en boga hoy por hoy. Cada año, se dan etre 800 y 1000 casos de gestación subrogada en la que se ven implicados ciudadanos españoles, familias con problemas de fertilidad, homosexualidad, personas solteras que quieren un hijo pero ningún vínculo con progenitores, etc…contratan  a agencias que les facilitan las gestiones para viajar a países como EEUU, Ucrania, Rusia o Canada. En España esta prohibido por ley, aunque la inscripción de los niños nacidos en el extranjero mediante esta técnica se haga de facto. Pese a los distintos criterios de los jueces, son 3  las sentencias del Tribunal Supremo que obligan al Estado  a reconocer la filiación de estos niños y desde hace una semana permite a esos padres cobrar la prestación por maternidad que reconoce la seguridad social.

En estos momentos hay dos posiciones enfrentadas, frente a esta situación: una favorable a la regulación en España, siempre de tipo altruista, que trate de ofrecer las mayores garantías a todas las partes implicadas.  Y la contraria, en la que coinciden paradójicamente colectivos religiosos y feministas, que en campañas como “No somos vasijas” califican esta práctica de “violencia obstétrica extrema” resaltando la explotación de las mujeres en terceros países.
Es cierto que la gestación subrogada es un laberinto ético, jurídico, político y hasta sentimental, en el que abundan las opiniones viscerales, porque es un tema que  los antropólogos califican como anomalía cultural.

Aurora González Ginzo, portavoz de la Asociación por la Gestación Subrogada en España comenta que nos encontramos con diferentes tipos de familias, cada una con su historia de frustraciones y deseos. “Nuestra asociación está formada por familias que no  pueden irse al extranjero porque no tienen los medios económicos necesarios y también por mujeres que nos ofrecemos como gestantes que es mi caso. Yo tuve a mis dos hijos y me gustaría ayudar a alguien a formar su familia”.
En los últimos años, la mayoría de los españoles que recurren a esta técnica acuden a EEUU, sobre todo al estado de California, donde un contrato de estas características puede suponer un gasto de entre 120000 euros, de los que habitualmente el 25% va a parar a la gestante. Los que no pueden permitirse estas facturas, en países como Tailandia, India, Camboya o Nepal, acuden cada vez más a “Rusia y Ucrania, donde hay una pobreza estructural.

Por otro lado, Grecia y Portugal abren una vía de esperanza para estas familias, ya que son, junto al Reino Unido, los únicos países europeos que permiten, bajo estrictas condiciones y siempre desde la perspectiva altruista, la gestación subrogada.
La doctora Mónica López Barahona, profesora de Oncología Molecular y Bioética en la Universidad Francisco de Vitoria y presidenta de la Fundación Lejeune, esta práctica “supone riesgos para la salud y es una explotación de la mujer pura y dura, que tampoco tiene en cuenta los derechos de los niños”. Defiende dejar la ley tal como está, y apuesta por una alternativa que pasa necesariamente “por la adopción, y por esa gran desconocida que es la acogida permanente. Hay cerca de 700 niños de entre 0 y 2 años que están ahora mismo en instituciones tuteladas por la comunidad de Madrid , sin opción alguna de retorno a su familia biológica.

El problema es que la mayoría de estas familias, o no se han planteado la adopción porque desean ante todo tener un vínculo genético con sus hijos, o no cumplen con los estrictos requisitos para adoptar que existen tanto en España como en el extranjero.
Por ultimo preguntamos a Ana García Fernández, vocal de feminismo y diversidad familiar del Cogam “queremos que se regule y controle a través de una agencia estatal, para evitar que intermediarios busquen el dinero en esto.  Eso también ayudaría a acabar con lo que está ocurriendo en algunos países, en los que se están dando situaciones en las que se aprovecha la precariedad económica. “ esto no va a suponer que todas las mujeres que necesiten llegar a fin de mes se vayan a prestar a ser gestantes subrogadas. Porque ellas no se van a lucrar, más allá de una compensación por las molestias, y es un proceso complejo y que implica riesgos y obligaciones.
La polémica está servida y como toda situación complicada solo es necesario establecer unas normas y protocolos para regularizar una situación. Esforzarse y pensar en cómo es cosa de los políticos ya que su cometido es velar y trabajar por el bien estar del pueblo.
